Terms of Service
Effective date: October 1, 2026
Please read these Terms carefully. They are a binding legal agreement between you and ReferADriver. By visiting the site, creating an account, posting a job, or buying a membership, you agree to them. Section 20 requires most disputes to be resolved by individual arbitration instead of in court, and waives your right to bring or join a class action or jury trial. You can opt out of arbitration within 30 days, as explained in Section 20. If you don't agree to these Terms, don't use the site.
1. Definitions
In these Terms of Service (the “Terms”):
- “ReferADriver,” “we,” “us,” and “our” mean the owner and operator of the ReferADriver website, together with its owners, officers, employees, contractors, and agents.
- “Site” means the ReferADriver website, every page and feature on it, and any related emails, forms, and services we provide.
- “You” means any person who visits or uses the Site in any way. If you use the Site for a company or other organization, “you” also includes that organization, and you confirm you have authority to bind it to these Terms.
- “Poster” means anyone who creates, submits, or maintains a job post.
- “Job Seeker” means anyone who views job posts or contacts a Poster.
- “Employer” means the company a job post is about.
- “User Content” means anything you submit to or through the Site, including job details, text, pay information, names, contact details, photos, videos, screenshots, messages, and feedback.
- “Membership” means a paid plan or free trial that keeps a job post live.
- “Including” means “including without limitation.” Lists of examples are never complete lists.
2. What ReferADriver is (and isn't)
ReferADriver is an online listing service. It lets truck drivers share information about jobs at the companies they work for, and lets other drivers find those jobs and contact the Poster or apply to the Employer.
ReferADriver is not:
- an employer, and nobody becomes our employee by using the Site;
- a recruiter, staffing agency, employment agency, or hiring service;
- a party to, or responsible for, any job application, interview, hiring decision, employment relationship, or employment terms;
- a party to, or responsible for, any referral program, referral bonus, or agreement between users;
- an agent or representative of any Employer, Poster, or Job Seeker.
We do not guarantee that any job post is accurate, current, or legitimate, that any job is still open, that anyone will be hired, that any referral bonus exists or will be paid, or that you will receive any particular number of views, contacts, applications, or hires. Every hiring decision is made solely by the Employer.
3. Who can use the site
You may use the Site only if all of the following are true:
- you are at least 18 years old and able to form a binding contract;
- you are not barred from using the Site under any law, and we have not previously suspended or banned you;
- you use the Site only for lawful purposes and in line with these Terms.
The Site is intended for users in the United States. If you use it from elsewhere, you do so on your own initiative and are responsible for following your local laws.
4. Accounts and security
- The information you give us for your account (your name, email address, phone number, and payment details) must be accurate, complete, and kept up to date. You may choose what name appears publicly on your post, but you may not give us false account information.
- Each person may have only one account and one free trial, unless we agree otherwise in writing. You may not create accounts using someone else's identity or contact details, or create extra accounts to get additional free trials, avoid a suspension, or avoid paying.
- You are responsible for keeping your password secret and for all activity that happens under your account, whether or not you authorized it. Tell us right away at [email protected] if you believe your account has been accessed without permission.
- You may not sell, transfer, rent, or share your account.
5. Posting jobs: your promises
Each time you submit, edit, or keep a job post live, you represent and promise that:
- You currently work for the Employer as a driver or in another role that gives you first-hand knowledge of the job, or the Employer has expressly authorized you to post it. If you stop working for the Employer, you must pause or remove the post right away.
- The job is real and open (or expected to open) at the Employer, and everything in the post, including pay, hours, schedule, route, equipment, benefits, requirements, and referral bonus information, is truthful, accurate, current, and not misleading to the best of your knowledge. You will update or pause the post promptly if anything changes or the job closes.
- Posting doesn't break any agreement or policy you're bound by, including your Employer's confidentiality, social media, communications, or referral-program policies. You are solely responsible for confirming this.
- The post doesn't reveal your Employer's trade secrets, confidential or non-public information, or anyone's private information.
- You own, or have all rights and permissions needed to share, everything you upload, including photos, videos, and screenshots, and the names, likenesses, and voices of anyone in them.
- Any photo, video, or document you upload has had sensitive information removed, including Social Security numbers, employee ID numbers, bank account numbers, and home addresses.
- Your post and your conduct comply with all applicable laws, including equal employment opportunity, anti-discrimination, wage, consumer protection, and privacy laws.
You are solely responsible for your User Content and for any consequences of posting it, including any action your Employer takes in response.
6. Content rules
You may not submit or link to User Content that:
- is false, misleading, exaggerated, or invented, including fake jobs, fake companies, fake pay figures, or fake referral bonuses;
- is posted by or for a recruiter, staffing agency, lead-generation service, or third party, unless we have agreed to it in writing;
- discriminates, or expresses a preference or limitation, based on race, color, religion, sex, sexual orientation, gender identity, national origin, age, disability, genetic information, veteran status, or any other legally protected characteristic, except where legally permitted (for example, legally required age or licensing minimums);
- asks Job Seekers to pay any fee, buy anything, invest, or recruit others (including multi-level marketing, “work from home” schemes, or training fees), or is otherwise a scam;
- asks Job Seekers for Social Security numbers, bank or card details, government ID numbers, or other sensitive information outside a legitimate Employer application process;
- is defamatory, harassing, threatening, hateful, obscene, sexually explicit, violent, or invades anyone's privacy;
- infringes anyone's copyright, trademark, privacy, publicity, or other rights;
- contains viruses, malicious code, tracking pixels, or links to harmful or unrelated sites;
- is spam, advertising for unrelated products or services, or duplicate posts of the same job;
- impersonates any person, company, or organization, or falsely suggests a connection with any person, company, Employer, or ReferADriver.
7. Referral bonuses and side agreements
- Referral bonuses are paid by Employers, not by ReferADriver. Whether a bonus exists, who qualifies, how much it is, when it's paid, and any conditions (such as how long the new hire must stay) are decided entirely by the Employer's own program. We do not pay, guarantee, collect, track, or enforce referral bonuses.
- Posters are responsible for confirming that their Employer's referral program exists and that they are eligible before posting, and for following that program's rules.
- Any offer by a Poster to share part of a referral bonus with a Job Seeker (a “split”), and any other arrangement between users, is a private agreement between those users only. ReferADriver is not a party to it, doesn't verify it, and isn't responsible if it isn't honored. Make sure any split is allowed under your Employer's policies.
- You are responsible for any taxes on money you receive.
- The earnings tables and examples on the Site are illustrations based on sample referral bonus amounts. They are not promises or predictions of any income.
- Any dispute about a referral bonus or a split is between you and the Employer or the other user. You release ReferADriver from any claims arising from those disputes, to the fullest extent the law allows.
8. For job seekers
- Job posts are written by individual users, not by Employers or by us. Always verify job details directly with the Employer before relying on them or making any decision.
- Apply through the Employer's official application process. ReferADriver doesn't submit applications or communicate with Employers for you.
- Never send money, pay a fee, or give financial account information to anyone in order to get a job or a referral. Report anything suspicious to us.
- You are responsible for your own decisions, interactions, and safety when contacting Posters or Employers, whether online or in person.
9. Sample posts
The Site may show example listings labeled “Sample” or “Sample Post” to show how the Site works. Sample posts are not real job openings, and their companies, people, pay, bonuses, and contact details are fictional. Any resemblance to real companies or people is coincidental. Do not apply to, contact, or rely on sample posts.
10. Free trial, memberships, and billing
Free trial
- New Posters may receive a 7-day free trial, limited to one per person and one per Employer location unless we agree otherwise. No payment information is required to start it.
- When the trial ends, your post is paused unless you choose a paid Membership. We do not charge you automatically when a free trial ends, because no payment method is collected for it.
- We may change, limit, or end free trials at any time for new users.
Paid memberships and automatic renewal
- Current prices are shown on the Site before you pay. As of the effective date, it is $239.88 per year (equal to $19.99 per month), billed once a year.
- Paid Memberships renew automatically at the end of each yearly billing period at the then-current price, and your payment method will be charged at each renewal, until you cancel. By buying a Membership you authorize these recurring charges.
- Payments are processed by our payment provider (Stripe) under its own terms. You must give a valid payment method you're authorized to use.
- Prices do not include taxes. You are responsible for any applicable sales, use, or similar taxes.
- We may change prices for future billing periods. We'll notify you by email at least 30 days before a price change applies to your Membership, and you can cancel before it takes effect.
- If a payment fails, we may retry it, pause your post, or end your Membership.
Cancellation
- You can cancel at any time by emailing [email protected] or through any cancellation option we provide. Cancelling stops future renewals; your post stays live until the end of the period you've already paid for.
Refunds
- All payments are final and non-refundable, including for partial billing periods, unused time, posts you pause or remove, or posts we remove for breaking these Terms, except where a refund is required by law or we decide in our sole discretion to issue one.
- A Membership keeps a post live on the Site. It does not guarantee any views, contacts, applications, hires, or referral bonuses, and a lack of results is not a reason for a refund.
- If you dispute a charge with your bank or card issuer instead of contacting us first, we may suspend your account while the dispute is open.
11. Our right to review and remove
We are not required to monitor or review posts, and we don't verify them, but we may. At any time and for any reason, with or without notice, we may:
- review, approve, reject, or delay any post before or after it goes live;
- edit a post's formatting, spelling, or layout, or remove information that breaks these Terms, as long as we don't change its meaning;
- pause or remove any post or User Content;
- ask you to verify your identity, your employment with the Employer, or the accuracy of a post;
- share information about a post with an Employer or authorities if we believe it is fraudulent, unlawful, or harmful.
Removing content or accounts that break these Terms does not entitle you to a refund.
12. Your content and our license to it
- You keep ownership of your User Content.
- You give ReferADriver a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to host, store, copy, display, publish, format, adapt for display, and distribute your User Content in connection with operating, improving, and promoting the Site (for example, showing your post on listing pages, in search results, or in marketing that features example posts). This license lasts for as long as your content is on the Site, plus a reasonable time afterward for backups, legal records, and content already shared.
- If you send us ideas, suggestions, or feedback, we may use them freely without paying or crediting you.
13. Our content and trademarks
Except for User Content, everything on the Site, including its design, text, graphics, logos, the ReferADriver name, code, and the selection and arrangement of content, belongs to ReferADriver or its licensors and is protected by intellectual property laws. We give you a limited, personal, non-exclusive, non-transferable, revocable permission to use the Site for its intended purpose under these Terms. We reserve all rights not expressly granted. Employer names and trademarks shown in posts belong to their owners and appear only to identify where a job is; their appearance does not mean the Employer endorses or is connected with ReferADriver.
14. Prohibited conduct
You may not, and may not help or allow anyone else to:
- use bots, scrapers, crawlers, or any automated means to access, copy, or collect anything from the Site, including job posts or contact information;
- collect or use other users' contact information for spam, marketing, recruiting for third parties, or any purpose other than discussing the job posted;
- copy, republish, sell, or commercially exploit job posts or other Site content;
- use the Site to build or support a competing service;
- interfere with, overload, probe, scan, or test the vulnerability of the Site, or bypass any security, access, or usage limit;
- reverse engineer, decompile, or try to extract the Site's source code, except where the law expressly allows it;
- submit spam or automated form submissions, or abuse our contact or posting forms;
- harass, threaten, stalk, deceive, or defraud any user or Employer;
- misrepresent your identity, employment, or authority;
- use the Site in any way that breaks any law or these Terms.
15. Third-party services and links
The Site relies on and links to services we don't control, such as payment processors, form and email services, analytics providers, Employer websites and applications, and social media platforms. Their own terms and privacy policies apply. We aren't responsible for their content, availability, accuracy, or practices, and your dealings with them are solely between you and them.
16. Disclaimers
THE SITE AND ALL CONTENT, POSTS, AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, REFERADRIVER DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND THOSE ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; THAT ANY POST OR USER IS GENUINE, ACCURATE, OR LAWFUL; OR THAT USING THE SITE WILL RESULT IN ANY JOB, HIRE, INCOME, OR REFERRAL BONUS. NOTHING ON THE SITE IS LEGAL, TAX, FINANCIAL, OR EMPLOYMENT ADVICE.
Some states don't allow certain warranties to be disclaimed, so some of the above may not apply to you.
17. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, REFERADRIVER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, WAGES, EARNINGS, REFERRAL BONUSES, EMPLOYMENT, EMPLOYMENT OPPORTUNITIES, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THE SITE, THESE TERMS, ANY USER CONTENT, ANY EMPLOYER, OR ANY INTERACTION BETWEEN USERS, EVEN IF WE WERE TOLD SUCH DAMAGES WERE POSSIBLE.
OUR TOTAL LIABILITY FOR ALL CLAIMS OF ANY KIND ARISING OUT OF OR RELATED TO THE SITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
These limits apply to every legal theory (contract, tort, negligence, strict liability, statute, or otherwise) and even if a remedy fails of its essential purpose. They do not limit liability that cannot legally be limited, such as for our fraud or willful misconduct. Some states don't allow some of these limits, so they may not fully apply to you.
18. Your responsibility to us (indemnification)
To the fullest extent permitted by law, you will defend, indemnify, and hold harmless ReferADriver from and against all claims, demands, losses, damages, liabilities, fines, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your User Content; (b) your use or misuse of the Site; (c) your breach of these Terms or any law; (d) any claim by your Employer or anyone else related to your post, including breach of an employment, confidentiality, or social media policy; (e) any referral, split, or other arrangement you make with another user; or (f) your violation of anyone's rights. We may take control of the defense of any such claim at your expense, and you will cooperate with us. You may not settle any such claim without our written consent.
19. Suspension and termination
- We may suspend or end your access to the Site, your account, or any post at any time, with or without notice, if we believe you have broken these Terms or the law, created risk or possible legal exposure for us or others, or if we stop offering the Site.
- You may stop using the Site and ask us to close your account at any time.
- When your access ends, your right to use the Site ends immediately. Any part of these Terms that by its nature should continue will survive, including Sections 7, 10 (as to amounts owed and refunds), 12 through 18, 20, 21, and 25.
20. Dispute resolution and arbitration
Please read this section carefully. It affects your legal rights.
a. Informal resolution first
Before starting any formal proceeding, you and we agree to try to resolve a dispute informally. Send a written notice describing the dispute and the relief you want to [email protected], and we'll send any notice to the email on your account. If the dispute isn't resolved within 60 days after the notice is received, either side may begin arbitration.
b. Agreement to arbitrate
Except as stated below, any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or your relationship with ReferADriver, including disputes about the scope, validity, or enforceability of this arbitration agreement, will be resolved by final and binding individual arbitration, not in court. The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect, before a single arbitrator, and may be conducted by video, phone, or written submissions. The Federal Arbitration Act governs this section. The arbitrator may award the same individual relief a court could, but only on an individual basis.
c. Exceptions
Either side may (i) bring an individual claim in small claims court if it qualifies, and (ii) seek an injunction in court to stop actual or threatened infringement or misuse of intellectual property or unauthorized access to the Site.
d. Class action and jury trial waiver
You and ReferADriver may each bring claims only in an individual capacity, and not as a plaintiff or class member in any class, collective, consolidated, or representative action. The arbitrator may not combine more than one person's claims. You and ReferADriver each waive the right to a jury trial. If this class waiver is found unenforceable for any claim, that claim must be decided in court, not arbitration, and the rest of this section still applies to all other claims.
e. Time limit
To the extent permitted by law, any claim must be brought within one year after it arises, or it is permanently barred.
f. 30-day right to opt out
You may opt out of this arbitration agreement by emailing [email protected] with the subject “Arbitration Opt-Out” within 30 days after you first accept these Terms, including your name and the email on your account. Opting out does not affect any other part of these Terms.
21. Governing law and venue
These Terms and any dispute between you and ReferADriver are governed by the laws of the State of [STATE] and applicable U.S. federal law, without regard to conflict-of-law rules. Any dispute that is not subject to arbitration will be brought only in the state or federal courts located in [COUNTY, STATE], and you and we consent to the personal jurisdiction of those courts.
22. Copyright complaints
If you believe content on the Site infringes your copyright, email [email protected] with the subject “Copyright Notice” and include: your contact information; a description of the copyrighted work; the location of the content on the Site; a statement that you have a good-faith belief the use is not authorized by the owner, its agent, or the law; a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner; and your physical or electronic signature. We may remove content and end the accounts of repeat infringers.
23. Electronic communications
By using the Site, you agree to receive communications from us electronically, including by email and notices on the Site, and you agree that these satisfy any legal requirement that communications be in writing. We'll send account and service messages (such as confirmations, trial and renewal reminders, receipts, and policy updates) as long as you have an account. You can unsubscribe from promotional emails at any time using the link in them.
24. Changes to these Terms or the site
We may change these Terms at any time. We'll post the updated Terms with a new effective date, and if a change is material we'll give account holders reasonable notice by email or on the Site. Changes apply from the effective date shown, and they don't apply retroactively to disputes we were already aware of. If you keep using the Site after changes take effect, you accept them; if you don't agree, stop using the Site and cancel your Membership. We may change, suspend, or discontinue any part of the Site at any time.
25. General terms
- Entire agreement. These Terms, our Privacy Policy, and any terms shown when you make a purchase are the entire agreement between you and us about the Site, and replace any earlier agreements or statements.
- Severability. If any part of these Terms is found unenforceable, it will be enforced to the maximum extent possible, and the rest of the Terms stay in effect.
- No waiver. Our failure to enforce any part of these Terms is not a waiver of our right to enforce it later.
- Assignment. You may not transfer these Terms or your account without our written consent. We may transfer them, including in a merger, sale, or reorganization.
- No third-party beneficiaries. Nobody other than you and ReferADriver has rights under these Terms.
- Relationship. Nothing in these Terms creates any employment, agency, partnership, or joint venture relationship between you and us.
- Events beyond our control. We aren't responsible for delays or failures caused by events beyond our reasonable control, including outages, natural disasters, or failures of third-party services.
- Interpretation. Headings are for convenience only. These Terms won't be interpreted against either side because that side drafted them.
